To be eligible Texas law generally requires spouses to be married for at least ten years and the spouse seeking maintenance must prove that he or she cannot meet their minimum reasonable needs after exercising due diligence to try to meet those minimum reasonable needs. Generally, the maximum duration that the court can order maintenance is 5 years for a 10-19 year marriage; 7 years for a 20-29 year marriage; and 10 years for a 30+ year marriage. The maximum amount that the court can order is $5,000.00 per month or 20% of the payor’s gross monthly income, whichever amount is less. During the temporary order phase, courts may also grant temporary spousal support, acknowledging the legal duty of spouses to support one another during the divorce process.
